Statement On Preliminary Injunction Blocking Unconstitutional Florida Law

Washington, DC – On Wednesday, June 30th, U.S. District Judge Robert Hinkle granted a preliminary injunction preventing the enforcement of key parts Florida’s SB 7072, noting that “promoting speech on one side of an issue or restricting speech on the other—is not a legitimate state interest” and that the Florida laws “come nowhere close” to meeting the relevant legal standard. 

IA’s Senior Vice President and General Counsel Jon Berroya commented on the injunction, “While IA is encouraged that Judge Hinkle’s decision enjoined nearly all of the Florida laws that were challenged, this decision is likely to be appealed. We are confident that the Eleventh Circuit Court of Appeals will recognize that IA members’ ability to freely engage in First Amendment-protected content moderation activities is essential to protect consumers from a wide range of harmful activity, including foreign disinformation campaigns and spam.”
